Welcome to the March edition of the Bailiwick Legal newsletter.

This newsletter is for our clients, friends of our practice and special interest groups.

In this edition, we want to share with you the procedures we have adopted in order to continue to support and provide services to our valued clients in order to deal with the impact of Covid-19. There's also our latest articles about what to do in the event Covid-19 prevents you from fulfilling the requirements of a contract; the new Work Health & Safety Bill; and why a liability waiver is a must for any tourism business.
Covid-19 Announcement

The impact of the new Covid-19 is unprecedented and as a society we are coming to realise the implications that it will continue to have on businesses and communities. Here at Bailiwick Legal we have been briefing our team on good hygiene habits within our office, keeping them up to date with latest Government guidelines on isolating ourselves where we may be at risk of passing on the virus and ensuring we protect the people around us as best we can.

Most legal issues however do not come with the flexibility to postpone, reschedule or wait until things improve.  At Bailiwick Legal it will be business as usual assisting and representing our clients.  However, to ensure that we are able to keep working with you, for you, and minimise the risks to you and our staff, we have made a decision to restrict face to face meetings to the most urgent of situations only. We will continue to be available via email and phone and we also have the ability to meet via Skype, Whatsapp or facetime, so please don’t hesitate to contact us via one of these platforms.

There is no doubt that businesses will be impacted by the virus, both the uncertainty it is creating in our community and the impact on our economy. Some businesses – tourism and hospitality immediately come to mind, are already feeling the effects and it is likely that effects will be felt through most other industry sectors over the next few months. Here at Bailiwick Legal we are pro-actively advising clients how best to minimise the impacts on their businesses.

Have you considered what you need to know, do and implement to minimise harm to your business? Do you know your obligations in terms of paid leave, business closure and the like?  If you would like to trouble shoot some scenarios or simply use us as a sounding board for how Covid-19 might impact your business, then please don’t hesitate to contact us for a chat. We’re always available to assist where we can.

If you are an individual you might be concerned about your personal legal matters. We are here to assist clients with all aspects of their estate planning, including getting your Wills, Enduring Powers of Attorney and Enduring Powers of Guardianship in order.

The Federal Government recently announced a range of stimulus initiatives to minimize the economic impact of the virus: https://bit.ly/3b0JVmx

Similarly the WA Government has also released a stimulus package: https://www.wa.gov.au/organisation/department-of-the-premier-and-cabinet/coronavirus-covid-19-western-australian-government-response

At Bailiwick Legal we work with you, for you, so even if you have to self-isolate please know we are here working to get our clients through this difficult time.

Stay safe.

Industrial Mangslaughter and you: the Work Health and Safety Bill

By now you may be aware of the Western Australia’s Government’s intention to introduce the model Work Health and Safety laws which have already been implemented across Australia, except for Victoria and Western Australia. The vehicle for the change is the Work Health and Safety Bill 2019 (the Bill), currently having had its second reading in the Legislative Council.... Read More »

Why a liability waiver is a must have for your tourism business

One of the top areas we are asked about by businesses operating in tourism is limitation of liability and waivers. Do I need a waiver? What should be included? Can I use my friend/competitor’s waiver? Tourism businesses, specifically those offering tours and activities, appreciate that there are a number of, often uncontrollable, variables which impact upon their offering..... Read More »

Out & About
Wagin Woolorama 2020 - the 117th Wagin Agricultural Show

Bailiwick Legal headed out to Wagin on 6-7 March to be part of the Wagin Woolorama Trade Show. Jess & Philip made the journey down this year to represent the Firm, teaming up with 4Farmers, WA Farmers, & Drum Masters to provide a key advisory resource to visitors and a chance to catch up with clients and friends across the 2 days. The tent sundowner on Friday was a highlight of the visit and a welcome relief after a very warm day.

While this year followed the Woolorama tradition of a quieter Friday and bigger Saturday  Woolorama president Howie Ward said the warm weather over the two days added to the positive sentiment among attendees and exhibitors.

WA Farmers Annual Conference: Fuel the Tank 2020

On Friday 13 March 2020, Bailiwick Legal attended the WA Farmers Federation annual conference at The Westin Perth. The day was anything but unlucky and provided for an excellent line up of speakers and panel sessions, followed by a delicious dinner and Minister’s Address by the Honourable Alannah MacTiernan MLC. The event aimed to examine the fundamental drivers and inhibitors of farm business profitability and viability and key factors and risks associated in building larger and more profitable farm businesses.

Philip, Jess, Danielle and Brian attended the conference as a proud sponsor of the WA Farmers Federation. It was great to catch up with fellow farmers, agricultural businesses, Government members, academics and students and the wider agribusiness supply chain.

TCWA Network@Night

On 26 February 2020, Kim and Danielle boarded the MV James Stirling for the Tourism Council’s first Network@Night function of 2020. The focus of the event was networking and establishing new contacts with sponsors, industry colleagues and operators within the tourism industry whilst cruising the river. It was a wonderful night, despite the weather providing for an eventful ride!
