March is upon us and 2021 a distant memory already, and we are in full swing here at Bailiwick Legal.

CBH reported a record-breaking harvest with more than 21 million tonnes received. This is quite a feat given the challenges presented by the pandemic. A lack of labour and skill shortages being the biggest hurdles. Congratulations to WA growers.

It hasn't been a spectacular start to the year for everyone with the devastation of regional bush fires. The team has made themselves available to those impacted to offer free support and advice where possible.

Our focus as always is regional WA and how we can assist local agricultural and tourism businesses. This year we are taking that commitment a step further. Myself and the team will work remotely from regional towns regularly giving you the opportunity to meet with us face-to-face without the trek to West Perth.

Phil 22 years since admitted to law

January 2022 marks 22 years since Phil was admitted to law and what an adventure it has been.

There have been many ups and downs but there are three highlights that came to mind when we asked Phil.

Industrial Manslaughter

Are you ready?

New work, health and safety legislation including industrial manslaughter comes into play in March 2022.

What to look out for:

- Substantially higher penalties

- Possibility of a custodial sentence for a breach of a normal duty

- Introduction of industrial manslaughter as a crime

- Duty is an extension to all persons in the workplace

- Applies to organisations that provide advice on safety matters

Goals Setting & Gin Making

Some of the Bailiwick team kicked off the year at a gin-making and goal-setting workshop in West Perth.

There were some substantial personal and professional goals set and it is safe to say starting a gin-making business was not one of them. We will leave that to the experts.

Legal Insights

New Diversification Lease for Pastoralists

On 18 November 2021 the Minister for Lands, Tony Buti, announced that the Land Administration Act 1997 (WA) would be amended in 2022 to introduce a new, more flexible form of land tenure for unallocated Crown land and pastoral land known as a ‘diversification lease’.
